Privacy Policy

This Privacy Policy explains how Portside Social Club, Inc. (“Portside Social,” “we,” “us”) collects, uses and shares information when you visit portsidesocial.com (the “Site”), fill in one of our forms, or work with us as a client. We are a marketing agency based in San Diego, California. We wrote this policy to be read, not skimmed, so it is short and specific.
1. Information you give us
When you fill in a form on the Site, book a call, email us or become a client, we collect what you type: typically your name, email address, phone number, company or gym name, website, and anything you write in a message field. If you become a client we also collect billing details and the information needed to run your accounts, under a separate services agreement.
2. Information collected automatically
When you visit the Site, we and the third-party tools listed below collect information from your browser and device, including your IP address, approximate location, browser and device type, the pages you view, how long you stay, how far you scroll, where you click, the site or ad that referred you, and advertising identifiers such as the Google click ID (gclid) or similar parameters attached to the link you arrived on. If you submit a form, those advertising identifiers and campaign parameters are stored with your submission so we can tell which ad or campaign brought you to us.
3. Cookies and tracking tools we use
The Site uses cookies, pixels and similar technologies from the following providers. Each provider processes data under its own privacy policy.
- Google Tag Manager, Google Analytics 4 and Google Ads (Google LLC): site analytics, conversion measurement and remarketing. Google may use this data to show you our ads on other sites. You can opt out of personalised Google ads at adssettings.google.com and install the Google Analytics opt-out browser add-on.
- Google reCAPTCHA (Google LLC): spam protection on our forms. Its use is subject to the Google Privacy Policy and Terms of Service.
- Meta Pixel (Meta Platforms, Inc.): conversion measurement and remarketing on Facebook and Instagram. Manage your preferences at facebook.com/adpreferences.
- LinkedIn Insight Tag (LinkedIn Corporation): conversion measurement and remarketing on LinkedIn. Manage your preferences in your LinkedIn ad settings.
- Microsoft Clarity (Microsoft Corporation): session recordings, heatmaps and usage analytics that show us how visitors interact with the Site. Clarity masks text you type into form fields. See the Microsoft Privacy Statement.
- HubSpot (HubSpot, Inc.): form handling, contact records and website analytics for our own marketing.
- Leadsy: a visitor-identification service that attempts to match website visits to a business or contact profile so we can follow up with companies that show interest in our services. If you would rather not be identified this way, email us at the address below and we will exclude you.
- OpenAI measurement tag (OpenAI): advertising and referral measurement.
- Cloudflare and WP Engine: hosting, content delivery and security. These set functional cookies needed to serve the Site.
You can block or delete cookies in your browser settings. Doing so may stop some parts of the Site from working. Industry opt-out tools are also available at optout.aboutads.info and optout.networkadvertising.org.
4. How we use information
We use the information above to respond to your enquiry and book the call or check you asked for; to run and improve the Site; to measure which of our own ads and campaigns produce enquiries; to show you our ads on other platforms; to send you emails you have asked for, such as our newsletter, which you can unsubscribe from at any time using the link in each email; to provide services to clients under our agreement with them; and to comply with law and protect our rights.
We do not use your information to make automated decisions that have legal or similarly significant effects on you.
5. How we share information
We do not sell your personal information for money. We share it only with: the service providers listed in section 3 and the software we use to run the business (for example email, scheduling, document storage and accounting), who may only use it to provide their service to us; professional advisers; and authorities or other parties when required by law or to protect rights, safety and property. If Portside Social is sold or merged, information may transfer to the new owner under this policy.
Under California law, allowing advertising and analytics providers such as Google, Meta and LinkedIn to collect information through cookies for cross-context behavioural advertising may count as “sharing.” You can opt out as described in section 7.
6. How long we keep information
Enquiry and lead records are kept for up to three years from your last contact with us, then deleted or anonymised unless you have become a client or the law requires longer. Client records are kept for the length of our engagement and for seven years afterwards for tax and legal purposes. Analytics and session-recording data are kept for the retention period set in each tool, which we keep at or below the provider’s default.
7. Your privacy rights
If you are a California resident, the California Consumer Privacy Act as amended by the CPRA gives you the right to know what personal information we collect, use and share; to request a copy of it; to ask us to delete it; to ask us to correct it; to opt out of the sale or sharing of your personal information; to limit the use of sensitive personal information (we do not collect any); and not to be discriminated against for exercising these rights. Residents of other states with similar laws have equivalent rights.
To exercise any of these rights, or to opt out of sharing, email Ahoy@portsidesocial.com with the subject line “Privacy request.” We will verify your request by confirming the email address on file, and respond within 45 days. You may authorise an agent to make a request for you; we will ask for proof of that authorisation.
To stop marketing emails, use the unsubscribe link in any email we send. To stop retargeting ads, use the opt-out links in section 3 or clear your cookies.
8. Security
The Site is served over HTTPS. Form submissions, contact records and client data are stored with the providers named above, each of which maintains its own security programme. We limit access to people who need it to do their jobs. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
9. Children
The Site is for businesses and adults. We do not knowingly collect personal information from anyone under 16. If you believe a child has given us information, email us and we will delete it.
10. Links to other sites
The Site links to other websites, including our clients’ sites and social media. Their privacy practices are their own; please read their policies.
11. Changes to this policy
When we change this policy we will update the effective date at the top. If a change materially affects how we use information you have already given us, we will tell you by email or by a notice on the Site.
